Application by the appellants, on an appeal from a judgment of the Supreme Court, Nassau County, entered December 8, 2009, to substitute Miklos P. Petervary, as executor of the estate of Nicholas Petervary, for the deceased respondent Nicholas Petervary, and to amend the caption accordingly.
Upon the papers filed in support of the application, and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the application is granted, Miklos P. Petervary, as executor of the estate of Nicholas Petervary, is substituted for the deceased respondent Nicholas Petervary, and the caption is amended accordingly.
