| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to serve and file a supplemental brief on an appeal from an order of the Supreme Court, Kings County, dated April 27, 2009, to raise the issue as to whether the appellant is properly subject to registration under the Sex Offender Registration Act pursuant to Correction Law § 168-a(2)(d)(ii).
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and on or before November 16, 2011, the appellant may serve and file a supplemental brief raising the issue as to whether the appellant is properly subject to registration under the Sex Offender Registration Act pursuant to Correction Law § 168-a(2)(d)(ii).
