| DECISION & ORDER ON MOTION |
Motion by the respondent to enlarge the record on an appeal from an order of the Supreme Court, Kings County, dated February 5, 2010, issued pursuant to CPL 440.46, to include the minutes of the proceedings which occurred in the above-entitled action on October 11, 2001, and to enlarge the time to serve and file a brief.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is granted, and the respondent shall file the transcript of the proceedings on October 11, 2001, with the Clerk of the Court when the respondent files a brief; it is further,
ORDERED that the respondent's time to serve and file a brief is enlarged until December 2, 2011, and the respondent's brief must be served and filed on or before that date.
