New York State Association of Management Advocates for School Labor Affairs (MASLA) having moved for permission to file and serve a brief amicus curiae on the appeals taken herein from judgments of Supreme Court entered in the Office of the Clerk of the County of Yates on October 4, 2010 (Appeal No. 1), and May 4, 2011 (Appeal No. 2), and

Appellant having cross-moved for permission to file and serve a brief in response to MASLA's brief amicus curiae, and any other briefs amicus curiae that may be filed in these appeals from judgments entered October 4, 2010, and May 4, 2010,

Now, upon reading and filing the affirmation of Dennis G. O'Hara, Esq., dated October 11, 2011, the affirmation of Jennifer N. Coffey, Esq., dated October 14, 2011, and the notices of motion and cross motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that MASLA's motion insofar as it seeks to file and serve a brief amicus curiae is granted on the condition that the brief is filed and served in accordance with this Court's rules on or before November 28, 2011, and

It is further ORDERED that appellant's cross motion is denied.
