DECISION & ORDER ON MOTION

Motion by the appellant to stay enforcement of an order of the Supreme Court, Nassau County, dated September 28, 2011, pending hearing and determination of an appeal therefrom.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied; and it is further,

ORDERED that on the Court's own motion, the appellant shall perfect the appeal on or before December 19, 2011, the respondent shall serve and file a brief, if any, on or before January 18, 2012, and the appellant shall serve and file a reply brief, if any, on or before January 30, 2012; and it is further,

ORDERED that on the Court's own motion, the appeal is granted a preference and will be calendared after all of the briefs have been filed.
