DECISION AND ORDER
ON MOTION

Motion to strike portions of the appendices to respondents' briefs.

Motion by New York State Conference of Mayors and Municipal Officials for permission to file a brief amicus curiae upon the appeal and to argue as amicus curiae.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED that the motion to strike portions of the appendices to respondents' briefs is granted, without costs, only to the extent that pages A16-A18 of the appendix to the brief of respondents Wayne Bujold and Denise A. Wilson are hereby deemed stricken and page A10 of said appendix is deemed part of the record on appeal, and it is further

ORDERED that the motion to file the brief amicus curiae and to argue as amicus curiae is granted, without costs, only to the extent that the Clerk of the Court is directed to accept for filing the amicus brief received on October 24, 2011, and it is further

ORDERED that the Clerk of the Court shall accept for filing the reply brief of respondents received on October 27, 2011 and respondents shall file nine additional copies of the reply brief on or before November 4, 2011.
