Appellate Division

Motion by the plaintiff for leave to appeal to this Court from an order of the Appellate Term of the Supreme Court, Second, Eleventh, and Thirteenth Judicial Districts, dated April 11, 2011, which affirmed a judgment of the Civil Court, Kings County, entered November 18, 2009, and for leave to prosecute the appeal as a poor person.

Upon the papers filed in support of the motion and no papers having been filed in opposition or relation thereto; it is

ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further,

ORDERED that the motion is otherwise denied as academic.
