DECISION & ORDER ON MOTION

Renewed motion by the appellant on an appeal from a judgment of the Supreme Court, Suffolk County, entered January 29, 2008, for summary reversal on the ground that certain minutes of the trial proceedings cannot be reconstructed.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied with leave to renew after the completion of the reconstruction hearing directed by the decision and order of this Court dated September 11, 2008.
