| DECISION & ORDER ON MOTION |
Motion by the respondent-appellant on an appeal and cross appeal from an order of the Supreme Court, Queens County, dated February 4, 2011, to extend his time to comply with a decision and order on motion of this Court dated August 25, 2011, which directed that he file proof of payment of one-half the cost of the joint record on or before September 7, 2011, or his brief would be stricken.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted, and the respondent-appellant's proof of payment of one-half the cost of the joint record annexed to his motion papers is accepted for filing and deemed timely filed.
