| DECISION & ORDER ON MOTION |
Motion by Kayode Oseni for leave to reargue his prior motion pursuant to CPL 460.30 for an extension of time to take an appeal from a judgment of the County Court, Westchester County, rendered June 18, 2010, which was determined by decision and order on motion dated August 2, 2011.
Upon the papers filed in support of the motion and the papers filed in relation thereto, it is
ORDERED that the motion is granted, the decision and order on motion dated August 2, 2011, is recalled and vacated, and, upon reargument, the prior motion pursuant to CPL 460.30 for an extension of time to take an appeal is granted, and the motion papers are deemed to constitute a timely notice of appeal.
