| DECISION & ORDER ON MOTION |
Motion by Robert C. Mitchell for leave to withdraw as counsel for the appellant on an appeal from a judgment of the County Court, Suffolk County, rendered July 19, 2010, on the ground that the appellant has been deported and is no longer amenable to the jurisdiction of the Court.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied (see People v Ventura, ___ NY3d ___ [Oct. 25, 2011]; and it is further,
ORDERED that assigned counsel shall prosecute the appeal expeditiously in accordance with this Court's rules (see 22 NYCRR 670.1, et seq.) and written directions.
