Motion by appellant on an appeal from an order of the Justice Court of the Town of Goshen, Orange County, dated May 20, 2011, for an order deeming their allegations of error admitted or in the alternative compelling the Justice Court to file an amended return.
Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
ORDERED that the motion is granted to the extent of compelling the Justice Court to file an amended return, and such return shall be filed by the Justice Court with this court and served upon the parties within 21 days of the date of this decision and order (see, People v Hanson, 2 Misc 3d 130 [A], 2004 NY Slip Op 50092 [U] [App Term, 9 & 10 Jud Dists]; People v Quick, 2002 NY Slip Op 40275 [U] [App Term, 9 & 10 Jud Dists])
