Motion by the respondent to vacate a stay of enforcement of an order of the Supreme Court, Nassau County, entered September 13, 2011, pending hearing and determination of an appeal and cross appeal therefrom, which was granted by a decision and order on motion of this Court dated October 5, 2011.
