DECISION & ORDER ON MOTION

Motion by Khymani H. for leave to appeal to this court from a warrant of arrest of the Family Court, Kings County, dated November 1, 2011, and to stay the execution of the warrant, pending hearing and determination of the appeal.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to appeal is denied as the warrant of arrest is not appealable either as of right or by permission (see Family Ct Act § 1112); and it is further,

ORDERED that the branch of the motion which is to stay the execution of the warrant of arrest is denied as academic.
