Motion by the respondent-appellant, in effect, for leave to file a supplemental appendix containing a certain letter dated May 28, 2010, on an appeal and cross appeal from a judgment of the Supreme Court, Nassau County, entered October 26, 2010.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted and on or before December 6, 2011, the respondent-appellant shall serve and file a supplemental appendix containing the letter dated May 28, 2010.
