DECISION & ORDER ON MOTION

Motion by the respondent to stay enforcement of an opinion and order of this Court dated May 24, 2011, pending hearing and determination of the respondent's motion for leave to appeal to the Court of Appeals, and, if leave is granted, to stay enforcement pending hearing and determination of the appeal by the Court of Appeals. The respondent was admitted to the Bar at a term of the Appellate Division of the Supreme Court in the Second Judicial Department on April 10, 2002. By decision and order on application of this Court dated April 21, 2010, the application of the Grievance Committee for the Second, Eleventh, and Thirteenth Judicial Districts to impose reciprocal discipline upon the respondent, pursuant to 22 NYCRR 691.3, based upon disciplinary action taken against her by the United States District Court for the Southern District of New York was held in abeyance pending a hearing and the issues raised were referred to David I. Ferber, Esq., as Special Referee to hear and report. By opinion and order dated May 24, 2011, this Court disbarred the respondent based upon the discipline imposed by the United States District Court for the Southern District of New York, and denied the respondent 's motion for diversion, pursuant to 22 NYCRR 691.4(m). In light of the respondent's disbarment, by decision and order on motion of this Court dated June 1, 2011, the Grievance Committee's motion to suspend the respondent from the practice law, pending consideration of charges of professional misconduct against her, pursuant to 22 NYCRR 691.4(1), upon a finding that she was guilty of professional misconduct immediately threatening the public interest based on her failure to comply with the lawful demands of the Grievance Committee in connection with its investigation of six complaints of professional misconduct against her, was denied as academic.

On September 20, 2011, the Court of Appeals denied the respondent's motion for leave to appeal (see Matter of Saghir, 17 NY3d 710).

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the motion is denied as academic.
