Motion by the respondent to strike certain exhibits filed by the appellant pro se on an appeal from a judgment of the Supreme Court, Queens County, rendered July 23, 2008.
Upon the papers filed in support of the motion and no papers having been filed in opposition and in relation thereto, it is
ORDERED that the motion is granted and the Clerk of the Court, or his designee, shall remove any exhibit filed in connection with the appellant's pro se supplemental brief that was not part of his pro se motion to dismiss the indictment based on the failure to afford him the opportunity to testify before the grand jury.
