Appellant having moved to reschedule the oral argument of the appeal taken from a judgment of Monroe County Court, rendered August 31, 2009, and respondent having cross-moved for an extension of the time to file and serve a brief for said appeal,
Now, upon reading and filing the affirmation of William G. Pixley, Esq. dated October 13, 2011, the notice of motion with proof of service thereof, the affirmation of Leslie E. Swift, Esq. dated October 21, 2011, the notice of cross motion with proof of service there of, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and the appeal is removed from the calendar for the term of this Court commencing on February 21, 2012, and,
It is further ORDERED that the appeal shall be added to the day calendar for April 4, 2012, and
It is further ORDERED that the cross motion is granted, and the time to file and serve a respondent's brief is extended to January 3, 2012, and
It is further ORDERED that the time to file and serve a reply brief is extended to January 19, 2012.
