| DECISION & ORDER ON MOTION |
Motion by the appellant to be furnished with a copy of the transcript of certain grand jury testimony on an appeal from an order of the Supreme Court, Nassau County, dated September 15, 2010, and to enlarge the time to perfect the appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is to be furnished with a copy of the transcript of certain grand jury testimony is granted and on or before December 13, 2011, the District Attorney shall provide to the appellant's counsel a transcript of the complainant's grand jury testimony, which was entered into evidence as Exhibit 3 at the hearing held in connection with the order dated September 15, 2010; and it is further,
ORDERED that the branch of the motion which is to enlarge the time to perfect the appeal is granted, and the appellant's time to perfect the appeal is enlarged until January 12, 2012.
