Application, in effect, pursuant to 22 NYCRR 670.8(c)(2) to set a briefing schedule on appeals from a judgment of the Supreme Court, Orange County, dated September 19, 2011.
Upon the papers filed in support of the application and the stipulation of the parties dated November 28, 2011, it is
ORDERED that the application is granted, and the appellants Town Board of Town of Montgomery and New York State Department of Environmental Conservation shall serve and file their briefs on or before December 23, 2011; and it is further,
