and the papers filed in response and in opposition thereto, it is
ORDERED that the application is granted, without costs, and it is
further
ORDERED that the motion to consolidate and for permission to proceed as a poor person is denied, without costs, as academic.
The appeal taken by notice of appeal dated October 18, 2010 is removed from the January 2012 term of this Court and set down for the February
2012 term. The time to file and serve the responding brief and the brief of the attorney for the child is extended to December 28,
2011.
