The People of the State of New York, Respondent, v Thomas Keane, Appellant.

Appeal from a judgment of conviction of the District Court of Suffolk County, First District, rendered April 7, 2010. By decision and order of this court dated October 12, 2011, the appeal was stricken from the general calendar, the appeals calendar, and the ready day calendar on the ground that a District Court order which is the subject of review on this appeal stated that the court had, in considering appellant's speedy trial motion, reviewed transcripts, which had not been made part of the record on appeal.

On the court's own motion, this court having now been advised that, in fact, there are no such transcripts in existence, it is

ORDERED that the appeal is restored to the general calendar and to the appeals calendar, and the appeal will be placed on the December 15, 2011 ready day calendar.
