It is Ordered that plaintiff-appellant's motion to vacate this Court's July 7, 2009 order that dismissed the appeal is granted and the appeal reinstated on condition that he perfect his appeal by no later than the March 2012 term - the filing deadline is January 11, 2012. In the event of plaintiff-appellant's failure to comply with the foregoing condition, defendant-respondent may move on five days' notice for an order dismissing the appeal.
