ORDERED that the decision and order on motion of this Court dated October 28, 2011, in the above-entitled matter, on an appeal from a judgment of the County Court, Suffolk County, rendered October 13, 2010, is amended by deleting from the caption the surname "Benett" and substituting therefor the surname "Bennett."
