DECISION & ORDER ON MOTION

Motion by the appellants on appeals from two orders of the Supreme Court, Nassau County, entered October 26, 2010, and April 27, 2011, respectively, and a judgment of the same court entered August 1, 2011, to seal the records and briefs filed with the Clerk of this Court and the decision and order of this Court which determines those appeals.

Upon the papers filed in support of the motion and the papers filed in relation thereto, it is

ORDERED that the motion is denied as unnecessary as to those portions of the record on appeal which were sealed by two orders of the Supreme Court, Nassau County, dated July 1, 2010, and February 16, 2011, respectively, and the motion is otherwise denied; and it is further,

ORDERED that on or before January 17, 2012, the appellants, if they be so advised, may withdraw the record filed with the Clerk of this Court, which was not filed under seal, and substitute a record consisting of one volume to be filed under seal containing material which was sealed by the orders of the Supreme Court, Nassau County, dated July 1, 2010, and February 16, 2011, respectively, and a separate volume containing material which was not sealed by the Supreme Court, Nassau County.
