| DECISION & ORDER ON MOTION |
Motion by the petitioner for leave to appeal to the Court of Appeals from a decision, order and judgment of this Court dated August 16, 2011, which determined, inter alia, a proceeding pursuant to CPLR article 78 in the nature of prohibition, among other things, to prohibit the respondent William Condon, a Justice of the Supreme Court, from proceeding to trial in a criminal action entitled People v Lynch, pending in the County Court, Suffolk County, under Indictment No. 1988/10.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is denied.
