Appellant having moved for permission to proceed as a poor person and assignment of counsel on the appeal taken herein from an order of the Court of Claims entered in the Office of the Clerk of said court on May 31, 2011,

Now, upon reading and filing the statement of Armando Torres dated June 13, 2011, the other papers filed in support of the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the notice of appeal is deemed to be amended by deleting therefrom the words "Third Department" and inserting in place thereof the words "Fourth Department," and

It is further ORDERED that the motion insofar as it seeks permission to proceed as a poor person is granted to the extent set forth in this Court's rules (see 22 NYCRR 1000.3 [c] [2]), and

It is further ORDERED that the motion insofar as it seeks assignment of counsel is denied.
