| DECISION & ORDER ON MOTION |
Motion by the appellant to raise issues relating to the jury charge and prosecutorial misconduct in connection with a pending application for a writ of error coram nobis, in which the appellant was granted leave to serve and file a brief on the issue of whether the verdict as to robbery in the second degree and robbery in the third degree, submitted to the jury as counts 7 and 8, respectively, was repugnant, by decision and order of this Court dated October 4, 2011.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is,
ORDERED that the motion is granted.
