Application by the respondent Steven Fielman pursuant to 22 NYCRR 670.8(d)(2) to enlarge the time to serve and file a brief in a proceeding pursuant to Executive Law § 298 which was transferred to this Court by order of the Supreme Court, Suffolk County, dated March 30, 2011.
Upon the papers filed in support of the application and the papers filed in opposition thereto, it is
ORDERED that the application is granted and the brief of the respondent Steven Fielman which was submitted to the Clerk of this Court is accepted for filing and deemed timely served; and it is further,
ORDERED that the petitioner's reply brief, if any, shall be served and filed on or before January 10, 2012.
