Motion by the respondent/cross-petitioner for leave to reargue a proceeding pursuant to Executive Law § 298 to review a determination of the Commissioner of the New York State Division of Human Rights dated July 3, 2009, which was determined by opinion and judgment of this Court dated August 16, 2011, or, in the alternative, for leave to appeal to the Court of Appeals from the opinion and judgment of this Court.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied.
