Motion by Michael Cefola for leave to file a late notice of an appeal from a judgment of the Supreme Court, Rockland County, dated August 13, 2010.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied, as pursuant to CPLR 5501(a) the movant can raise issues in his brief regarding the interlocutory judgment entered June 23, 2010; and it is further,
ORDERED that the movant's time to serve and file a brief on the appeal is enlarged until February 21, 2012, and the movant's brief must be served and filed on or before that date.
