Appellant having moved to reschedule the oral argument of the appeal taken from a judgment of Supreme Court, Monroe County rendered May 26, 2006, and respondent having cross-moved for an extension of time to file and serve a brief on said appeal,
Now, upon reading and filing the affirmation of Drew R. DuBrin, Esq. January 4, 2012, the notice of motion with proof of service thereof, the affirmation of Stephen X. O'Brien, Esq. dated January 5, 2012, the notice of cross-motion with proof of service thereof, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and the appeal is removed from the day calendar for February 22, 2012, and
It is further ORDERED that the appeal shall be added to the calendar for the term of this Court commencing March 26, 2012,
It is further ORDERED that the cross-motion is granted, and the time to file and serve a respondent's brief is extended to February 21, 2012, and
It is further ORDERED that the time to file and serve a reply brief is extended to March 7, 2012.
