DECISION & ORDER ON MOTION

Motion by the respondent, inter alia, to dismiss appeals from three orders of the Supreme Court, Suffolk County, dated July 20, 2009, April 8, 2010, and May 11, 2010, respectively, on the ground, among other things, that the appellant's appendix is inadequate, or alternatively, to enlarge the time to serve and file a brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to dismiss the appeals is denied on condition that on or before February 14, 2012, the appellant serve and file a supplemental appendix containing the notices of motion and the affidavits or affirmations filed in support, opposition, and reply to the motions that were determined in the orders appealed from; and it is further,

ORDERED that the branch of the motion which is to enlarge the respondent's time to serve and file a brief is granted, the respondent's time to serve and file a brief is enlarged until March 15, 2012, and the respondent's brief must be served and filed on or before that date; and it is further,

ORDERED that the motion is otherwise denied.
