| DECISION & ORDER ON MOTION |
Motion by the respondent to seal the transcript of certain testimony which was submitted to the Supreme Court, Dutchess County, as Exhibit 3 of the respondent's answer and return, in a proceeding pursuant to CPLR article 78 which was transferred to this Court by order of the Supreme Court, Dutchess County, dated April 28, 2011.
Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is
ORDERED that the motion is granted and the transcript submitted to the Supreme Court, Dutchess County, as Exhibit 3 of the respondent's answer and shall be filed with this Court under seal.
