| DECISION & ORDER ON MOTION |
Motion by the respondent to dismiss an appeal from an order of the Supreme Court, Westchester County, dated June 13, 2011, on the ground that the order is not appealable as of right or by permission. Separate motion by Teofilo Tavarez for leave to appeal to this Court from the order dated June 13, 2011.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the respondent's motion is granted and the appeal is dismissed (see CPL 450.15 and 460.15); and it is further,
ORDERED that the motion by Teofilo Tavarez is denied.
