The People of the State of New York, Respondent, v Franshawn Carney, Appellant.

Motion by the appellant to vacate an order of this court dated September 13, 2011, which dismissed an appeal from a judgment of conviction of the City Court of Poughkeepsie, Dutchess County rendered November 12, 2010 and for an enlargement of time to perfect the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is hereby,

ORDERED that the motion to vacate is granted and the court's order dismissing the appeal is vacated; and it is further,

ORDERED that appellant's motion to enlarge the time to perfect the appeal is granted and appellant's brief shall be served and filed on or before March 2, 2012.
