DECISION & ORDER ON MOTION

The People of the State of New York, Respondent, v Charles Curcio, Appellant.

Motion by appellant for an enlargement of time to perfect an appeal from a judgment of conviction of the Criminal Court of the City of New York, Kings County, rendered October 14, 2010, and to compel the Criminal Court to file the record on appeal with this court.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the branch of the motion seeking an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by March 2, 2012; and it is further,

ORDERED that the branch of the motion seeking to compel the Criminal Court of the City of New York, Kings County, to file the record on appeal with this court is denied as moot, as the minutes have been settled by the Criminal Court and filed with this court.
