Appellants having moved, pursuant to CPLR 5518, for a preliminary injunction pending this Court's hearing and determination of the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Monroe on October 20, 2011, and
Appellants having also moved for leave to file under seal papers filed in this Court regarding appellants' motion for preliminary injunction,
Now, upon reading and filing the affirmation and statements of Christopher D. Thomas, Esq., dated December 16, 2011, the affidavit of Kevin Dickens sworn to December 16, 2011, the notices of motion with proof of service thereof, the affirmation and statement of Jeffrey J. Calabrese, Esq., dated December 22, 2011, and December 23, 2011, and the affidavit of Walter Robert Becklund sworn to December 22, 2011, and due deliberation having been had thereon,
It is hereby ORDERED that the motion insofar as it seeks a preliminary injunction is denied, and
It is further ORDERED that the motion insofar as it seeks for the motion papers to be filed under seal is granted.
