2010-05432 In the Matter of Samuel R. Branch, respondent, v Madona Cole-Lacy, appellant. (Docket No. F-03751-00)
| DECISION & ORDER ON MOTION |
Motion by the respondent, in effect, to dismiss an appeal from an order of the Family Court, Nassau County, dated April 9, 2010, as corrected by an order of the same court dated May 17, 2010, on the ground that the appellant failed to transcribe the minutes of proceedings which occurred on August 27, 2009, September 29, 2009, and November 5, 2009, which purportedly constitute part of the record on appeal.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the motion is denied; and it is further,
ORDERED that on the Court's own motion, the respondent's time to serve and file a brief is enlarged until February 27, 2012, and the respondent's brief shall be served and filed on or before that date.
RIVERA, J.P., DICKERSON, HALL and COHEN, JJ., concur.
