DECISION & ORDER ON MOTION

Raj Investments, Appellant, v Adrienne Dorns, Tenant, "John Doe," Respondent, and "Jane Doe," Undertenant.

Motion by appellant to stay an order of the Civil Court of the City of New York, Kings County, entered January 6, 2010. Separate motion by respondent Tyrone Swinton, sued herein as "John Doe," to accelerate the return date of appellant's motion.

Upon the papers filed in support of the motions and the papers filed in opposition thereto, it is

ORDERED, on the court's own motion, that the motions by appellant and respondent are consolidated for purposes of disposition; and it is further,

ORDERED that appellant's motion is granted on condition that the appeal be perfected on or before April 6, 2012; and it is further,

ORDERED that in the event that the above condition is not met, the court, on its own motion, may vacate the stay, or respondent may move to vacate the stay on three days' notice; and it is further,

ORDERED that respondent's motion is denied as moot.
