| DECISION & ORDER ON MOTION |
Motion by the appellant for leave to reargue appeals from two orders of the Supreme Court, Nassau County, entered May 17, 2010, and July 12, 2010, as amended July 26, 2010, respectively, which were determined by decision and order of this Court dated October 11, 2011, to clarify the decision and order of this Court dated October 11, 2011, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order of this Court dated October 11, 2011.
Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is
ORDERED that the branch of the motion which is for leave to reargue is granted to the extent that the decision and order of this Court dated October 11, 2011, is amended by deleting from the appearances thereof the following: "Perry Reich, Oakland Gardens, N.Y., appellant pro se" and substituting therefor the following: "Sgarlato & Sgarlato, PLLC, Staten Island, N.Y. (Richard Sgarlato of counsel), for appellant"; and it is further,
ORDERED that the motion is otherwise denied.
