DECISION & ORDER ON MOTION

Motion by the appellant pro se on an appeal from a judgment of the Supreme Court, Queens County, rendered July 24, 2007, for leave to reargue his prior motion for leave to serve and file a supplemental brief, which was determined by decision and order on motion dated September 15, 2011, or, in the alternative, for leave to appeal to the Court of Appeals from the decision and order on motion of this Court.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to reargue is denied; and it is further,

ORDERED that the branch of the motion which is for leave to appeal to the Court of Appeals is denied as unavailable (see CPL 450.70, 450.90).
