Respondent-respondent Steuben County Department of Social Services having moved to dismiss the appeal taken herein from an order of the Family Court, Steuben County, entered in the Office of the Clerk of said Court on June 29, 2011, on the ground that petitioner-appellant has failed to perfect the appeal timely,
Now, upon reading and filing the affidavit of Matthew M. McGrath, Esq., sworn to January 5, 2012, the notice of motion with proof of service thereof, and the affidavit of Emily Karr-Cook, Esq., sworn to January 27, 2012, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted and the appeal is dismissed without further order unless perfected on or before April 2, 2012.
