On the Court's own motion, it is
ORDERED that the decision and order on motion of this Court dated February 7, 2012, on an appeal from an order of the Supreme Court, Queens County, dated June 18, 2010, issued pursuant to CPL 440.46, is amended by deleting from the decretal paragraph thereof the word "abated" and substituting therefor the word "dismissed."
