DECISION & ORDER ON MOTION

Motion by the appellant, in effect, for leave to reargue an appeal from an order of the Supreme Court, Kings County, dated March 9, 2009, which was determined by decision and order of this Court dated October 18, 2011, to impose a sanction upon the respondent's counsel, and to waive the motion filing fee.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is to waive the motion filing fee is granted; and it is further,

ORDERED that the motion is otherwise denied.
