DECISION & ORDER ON MOTION

Motion by Tony C. to consolidate appeals from two orders of the Supreme Court, Queens County, dated December 15, 2010, and July 1, 2011, respectively, and to direct a briefing schedule.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is to consolidate the appeals is granted; and it is further,

ORDERED that the branch of the motion which is to direct a briefing schedule is granted, and Tony C. shall cause the original papers constituting the record on the appeals to be filed in the office of the Clerk of this Court (see 22 NYCRR 670.9[d][2]) and serve and file a brief on his appeal on or before April 16, 2012; and it is further,

ORDERED that the People of the State of New York shall serve and file a brief raising points of argument on their appeal and responding to the brief filed by Tony C. in connection with his appeal on or before June 18, 2012; and it is further,

ORDERED that Tony C. shall serve and file a brief responding to the brief filed by the People of the State of New York and in reply in connection with his appeal on or before July 23, 2012; and it is further,

ORDERED that the People of the State of New York shall serve and file a reply brief in connection with their appeal on or before August 17, 2012.
