DECISION & ORDER ON MOTION

The People of the State of New York, Appellant, v
Philip J. Cosimano, Respondent.

Motion by appellant on an appeal from an order of the Justice Court of the Village of Goshen, Orange County, dated October 3, 2011, for an order compelling the Justice Court to file a return to appellant's affidavit of errors, and for an enlargement of time to perfect the appeal.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion to compel a return to appellant's affidavit of errors is granted and such return shall be filed by the Justice Court with this court and served upon the parties within 21 days of the date of this decision and order, and it is further

ORDERED that the portion of appellant's motion for an enlargement of time to perfect the appeal is granted and the appeal shall be perfected by May 4, 2012.
