Respondents having moved to correct the record and to extend the of time to file and serve a brief on the appeal taken herein from an order of the Court of Claims entered in the Office of the Clerk of said court on May 17, 2011,

Now, upon reading and filing the affirmation of Phyliss A. Hafner, Esq., dated January 20, 2012, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to correct the record is granted on the condition that 11 copies of the signed and notarized affidavit of Larry Tussey sworn to February 23, 2011, are filed with this Court, and two copies are served on appellant's counsel, on or before March 28, 2012, and

It is further ORDERED that the motion insofar as it seeks an extension of time to file and serve a respondents' brief is granted on the condition that the brief is filed and served on or before March 28, 2012, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that reply briefs, if any, shall be filed and served on or before April 12, 2012.
