Now, upon reading and filing the affidavit of Torrie Jones sworn to December 9, 2011, the notice of motion with proof of service thereof, the statement of Donna A. Milling, Esq. dated January 18, 2012, and due deliberation having been had thereon,
It is hereby ORDERED that the motion is granted, and Torrie Jones is hereby directed to file the notice of appeal in accordance with CPL 460.10 at the Erie County Clerk's Office on or before March 29, 2012, and
It is further ORDERED that the notice of appeal served on April 27, 2011 upon the Erie County District Attorney's Office is hereby deemed timely served.
