DECISION & ORDER ON MOTION

Motion by the appellant Marshall Kaminer pro se on appeals from a decree of the Surrogate's Court, Nassau County, dated October 18, 2010, for leave to reargue his prior motion, inter alia, to enlarge the record to include certain documents, which was determined by decision and order on motion of this Court dated January 18, 2012, or, in the alternative, to extend the time to comply with so much of the decision and order on motion dated January 18, 2012, as directed him to remove certain material from the copies of the joint appendix filed with the Clerk of the Court or serve and file a replacement joint appendix and to serve and file a replacement brief.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is

ORDERED that the branch of the motion which is for leave to reargue is denied; and it is further,

ORDERED that the branch of the motion which is to extend the time to comply with the decision and order on motion dated January 18, 2012, is granted and the time to comply with the decision and order on motion dated January 18, 2012, is extended until April 4, 2012.
